Austria has updated the rules on temporary protection for Ukrainian citizens — the changes are set out in a decree of the Austrian government. Temporary protection is a special status that grants the right to reside and certain social rights, and it now includes new options for switching to regular residence permits.
Temporary protection in the country continues to apply until 4 March 2028.
Transition from temporary protection to a regular residence permit
Persons entitled to temporary protection will be able to submit applications for a residence permit under the Austrian Settlement and Residence Act (NAG) without leaving the country. A residence permit is the document that confirms the right to live lawfully in Austria.
Renunciation of temporary protection must be made in writing and is final; it only takes effect once the new residence permit has been issued. If an application is submitted before the temporary protection period expires, the stay remains lawful until a final decision is made on the application, provided there are no grounds for refusal.

Who may be refused temporary protection
The decree sets out restrictions for new arrivals from Ukraine who have not fulfilled military obligations under Ukrainian law and therefore were not entitled to leave the country; such persons who arrived after July 2026 may be denied temporary protection. If necessary, they must provide proof of having fulfilled the relevant obligations.
The restriction does not apply to those who already held temporary protection on or before 30 July 2026 and have maintained that status continuously. It is also specified that Austria will not grant temporary protection to those who already have such status in another EU state, to avoid simultaneous receipt of rights and assistance in multiple countries.

Financial requirements for switching to other grounds for residence
For many types of residence permits, applicants must demonstrate they have a regular income sufficient to support themselves and family members without relying on social assistance. General financial guidelines are published on the Austrian government’s official website information.
From 1 January 2026, regular expenses are taken into account when calculating required income, including rent and loan repayments; if such costs together exceed 386.43 euros per month, the amount exceeding that threshold is included when determining the necessary income. Confirmation of sufficient income under this general rule is not required for the EU Blue Card or the Red-White-Red Card.
Previous periods of lawful residence in Austria under temporary protection will be credited as settlement periods under the NAG, except in cases where a permit of the category Aufenthaltsbewilligung is issued; such crediting does not automatically confer the right to long-term residence. Applicants should check the specific requirements for the residence permit category they intend to apply for before submitting documents.
