Military personnel cannot exchange annual leave for money

Military personnel who continue to serve cannot, at their own request, waive their annual basic leave and receive monetary compensation instead. This was reported by Сумський обласний ТЦК та СП (Sumy Regional Territorial Centre for Recruitment and Social Support).

Duration of leave during martial law

During martial law, service members may be granted annual basic leave of up to 30 calendar days. The annual basic leave is the regular yearly rest period provided in the prescribed manner, taking into account the conditions of service.

When monetary compensation is paid

Current legislation does not provide for payment of compensation in lieu of unused annual basic leave to a service member who remains on duty. At the same time, when a person is discharged from military service they are paid monetary compensation for unused days of annual basic leave and for additional leave provided for by law.

This is provided for by Article 10−1 of the Law of Ukraine “On social and legal protection of servicemen and members of their families”. Therefore, before discharge it is worth confirming with the personnel department the number of unused days and checking with the finance department the procedure for calculating the amount due.

Service members also have the right to take leave for family reasons or other valid reasons with retention of pay.
