The Motor (Transport) Insurance Bureau of Ukraine (MTSBU) explained the procedure to follow in a road traffic accident when the other driver does not have a valid motor insurance policy. The statement sets out a step‑by‑step algorithm for actions at the scene and the procedure for settling the insurance claim.
Immediate actions at the scene of the accident
Stop your vehicle immediately, switch on your hazard warning lights and place a warning triangle. Do not move vehicles or items related to the accident until the circumstances have been documented.
If there are injured people, provide first aid and call an ambulance. Notify the police, record witnesses’ contact details and wait for law enforcement officers to document the incident.

Documentation and the possibility of the European Accident Statement
Check whether both vehicles have valid internal policies of compulsory motor third‑party liability insurance (ОСЦПВ) or foreign «Green Card» policies. If the other driver does not have a valid policy, it is not possible to complete the European Accident Statement.
If both drivers have valid internal ОСЦПВ policies and the other legal conditions are met, the accident can be documented using the European Accident Statement, including electronically via «Diia».
Settlement of the insurance claim and insurance limits
If your vehicle is covered by a valid internal ОСЦПВ policy, you can contact your insurer for direct settlement of losses even if the at‑fault party lacks a policy. This enables you to initiate payments through your own insurer.
Insurance sums under internal ОСЦПВ policies were set by resolution of the Board of the National Bank of Ukraine of 30 May 2022 No. 109 and have been in effect since 1 July 2022.
