Supreme Court confirms recovery of 5 million UAH from private clinic

In March 2026 the Supreme Court of Ukraine confirmed the recovery of 5 million UAH in moral damages from a private clinic due to medical negligence. Case law also records instances where Ukrainian courts awarded multi-million compensations for medical errors.

Ivano‑Frankivsk City Court awarded 3 million UAH in moral compensation

The Ivano‑Frankivsk City Court ordered a hospital to pay a patient 3 million UAH in moral compensation due to a negligently performed surgical procedure. The court also awarded reimbursement of treatment costs and lost earnings.

The appellate court left that decision unchanged, so the judgment took effect after the appeal. The decision recorded both moral and material components of the compensation.

Supreme Court confirmed recovery of 5 million UAH

In March 2026 the recovery of 5 million UAH in moral damages from a private clinic was confirmed in a case that lasted 6.5 years. This case has been described as illustrative in the practice of awarding compensation for medical negligence.

The Supreme Court also noted that the amount of moral damages depends on the circumstances of each case, the depth of physical and psychological suffering and the consequences for the victim. This approach reflects the individual consideration of each case.

Out-of-court settlement and an example from dentistry

In 2023, during an operation at a private clinic, an organ was removed from a patient without proper medical justification; after four months of negotiations the institution agreed to pay compensation covering treatment, rehabilitation, medication, psychotherapy and legal assistance. The parties did not disclose the settlement amount.

Patient by a private clinic with documents

Separately, in Ivano‑Frankivsk a private dentist must pay a patient 74,730 UAH for poor-quality dental prosthetics. The appellate court ordered the recovery of 64,730 UAH in material damages and 10,000 UAH in moral compensation, and the Supreme Court on 30 November 2022 left that decision unchanged.

What you can claim and how to prove it

A patient has the right to claim a refund for the cost of a substandard medical service, reimbursement of expenses for repeat treatment and compensation for moral damages. To do so it is necessary to prove the fact of improper treatment and the causal link between the actions of medical staff and the harm caused.

To substantiate claims it is recommended to keep contracts with the clinic, receipts, medical reports, test results and expert opinions. Initially you can submit a written complaint to the clinic management; if no agreement is reached, the patient has the right to go to court, where the final amount of compensation will be determined taking into account the circumstances of the case.
